Membership Agreement and Release/Waiver of Liability

IMPORTANT: THIS IS A BINDING LEGAL AGREEMENT. IT AFFECTS YOUR LEGAL RIGHTS AND YOUR ABILITY TO PURSUE LEGAL ACTION; PLEASE READ ALL SECTIONS CAREFULLY BEFORE AGREEING TO AND ACCEPTING THESE TERMS.

In order to become a member at the Regional Recreation Corporation of Wood Buffalo (the “RRC”)’s Miskanaw Golf Club (the “MGC”) the undersigned (referred to herein as the “Member”), accepts and agrees to the terms of this Membership Agreement, Release and Waiver of Liability (the “Release”) in favor of the RRC, the Regional Municipality of Wood Buffalo (the RMWB); and each and every elected official, director, officer, employee, affiliate, agent, delegate, representative, contractor, supplier, volunteer, sponsor and all individuals associated with the RRC and the RMWB with respect to their involvement with the RRC in any way (collectively all such parties are the “Released Parties”).

Assumption of Risk: The Member acknowledges that there are risks inherent in participating in the game of golf, including risks that could be hazardous to the Member, and may put the Member at risk of serious injury or illness, including death and other losses. The Member acknowledges that risks, dangers and losses may arise from a number of circumstances, including but not limited to those caused by terrain; the effects of weather, including but not limited to  thunderstorms and lightning; wet or icy or otherwise dangerous surfaces; falling objects and trees; flora and fauna like bears, foxes, poison ivy and others; traffic and vehicles including golf carts and other vehicles; equipment; facilities; failure to follow safety procedures; diagnosed or undiagnosed health conditions, the actions of other people (including spectators and Released Parties) and negligence of Released Parties. This Release covers claims of liability and death, personal injury and property damage arising out of my participation no matter how caused or whether foreseen or not.

Medical Treatment: If the Member is unable to consent at the material time due to injury or illness that occurs during the Member’s presence at the MGC, the Member consents to the administration of first aid or other emergency medical treatment. The Member releases and forever discharges the Released Parties from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services provided to the Member.

Rules and Directions: The Member agrees to comply with all rules, regulations and instructions of the MGC, and of all officials and volunteers of the MGC.

Membership Fee: The Member acknowledges and agrees that this is a binding legal agreement to pay all current and future dues to the RRC including but not limited to all installments under any installment plan. The Member acknowledges and agrees that there are no refunds, transfers or deferrals for all fees paid. Any payments returned NSF, account closed or credit card rejected will be subject to a $25.00 (twenty-five dollar) reinstatement charge. The Member further understands that in the event of any default hereunder, in addition to principal, interest and late charges, the RRC shall be entitled to collect all costs of collection, including but not limited to, reasonable attorneys' fees incurred in connection with any of RRC’s collection efforts, whether or not a suit is filed, and any and all such costs and expenses shall be payable by the Member on demand.

Storage Liability: The MGC provides seasonal golf club storage and golf cart storage (grandfathered – no new stalls available) for a fee. The MGC shall not be responsible for any property loss or damage that may occur to the Member’s golf clubs, golf carts and any other equipment while on MGC premises. Members must have their own insurance coverage for public liability, property damage, fire and theft for any property left at the MGC.

No-Show Charge: Pre-booked tee times are cancellable. All cancellations require a minimum of 24 hours notice: either in person; or on the phone to an authorized employee. Voicemail messages will not be accepted. Failing to cancel all confirmed playing slots within the prescribed time will result in the Member’s credit card being charged $50.00 (fifty dollars) per player not showing up

Applicability and Enforceability: The Member expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the Province of Alberta. The Member agrees that if any part of the Release is held to be invalid or illegal or unenforceable for any reason, such part shall be deemed severed and its invalidity or illegality or unenforceability shall not affect the remaining provisions of this Release, which shall continue to be enforceable. This Release shall be governed by the laws of the Province of Alberta.

For Members Under 18: The undersigned parent or legal guardian of the Member personally represents and warrants that he or she is duly authorized to agree to this Release on behalf of the Member, and on behalf of all the parents and guardians of the Member. The undersigned parent or legal guardian of the Member has read the release and confirms that he or she hereby agrees to and provides the Release for and on behalf of the Member, and for and on behalf of himself or herself and all parents and guardians of the Member, and agrees to all of the provisions and terms of the Release.

I THE MEMBER (OR PARENT OR LEGAL GUARDIAN OF THE MEMBER UNDER 18) AM AT LEAST 18 YEARS OLD, HAVE READ THIS DOCUMENT , AND  UNDERSTAND WHAT IT SAYS AND INTENTIONALLY AND VOLUNTARILY SIGN THIS RELEASE AND WAIVER OF LIABILITY AND THAT BY DOING SO AM WAIVING SUBSTANTIAL LEGAL RIGHTS, WHICH THE MEMBER (OR PARENT OF LEGAL GUARDIAN OF THE MEMBER UNDER 18), THE MEMBER’S HEIRS, NEXT OF KIN, EXECUTORS AND ADMINISTRATORS, AND ANYONE ELSE WHO MIGHT CLAIM OR SUE IN THE MEMBER’S NAME OR ON THE MEMBER’S BEHALF, MAY HAVE AGAINST THE RELEASED PARTIES.
